Habanaloko Limited will reserve your holiday subject to the following conditions and cannot confirm flights and accommodation unless a signed copy of this document has been received prior to departure. Habanaloko Limited reserves the right to vary these terms and conditions at any time.


Introduction
Habanaloko hope that your holiday will live up to your expectations and we will do our best to achieve them. We must point out that this type of holiday, due to the ‘unusual nature’ of Cuba as a holiday destination carries a risk that accommodation, transportation schedules and other parts of the holiday may be subject to alterations beyond our control and occurring at short notice. We regard this as a feature of the holiday and while we will do our best to provide you with the holiday you booked you must be prepared to accept that changes may occur and local difficulties outside our control may arise.

Holiday Contract:
When making your booking you must be at least 18 years old and accept the terms of these booking conditions by signing below. A contract will exist when a confirmation invoice has been issued to you. This contract is made on the terms of these booking conditions which are governed by English Law, and both parties shall submit to the jurisdiction of the English Courts at all times accepting that some bookings will be made outside of England.

To secure your booking:
Many airlines now require the full names of all passengers travelling. In order to reserve your place a completed online booking form, showing your full name as it appears on your passport and a non refundable deposit of £150 per person is required. We will send you a balance invoice detailing the amount due. The booking is not confirmed and accepted until you send us the full balance and we send you written confirmation and issue you with an invoice. If we do not confirm, all money paid by you to us will be refunded in full subject to the cancellation charges shown below. Habanaloko Limited reserves the right to decline any booking at their discretion. The date shown on the invoice which will be sent to you upon receipt of the balance is the date of booking. It is important to check the details on the invoice when you receive it and contact us immediately if there is any discrepancy.
If you wish to make a modification to the holiday offered and choose alternative dates, flights or hotels this can be arranged, subject to availability. Prices will be subject to alteration as applicable and will incur an administration charge of £50 per booking, per service. Any additional services will be quoted for upon request. Should you wish to extend your holiday by making your own travel arrangements, this can usually be done subject to an administrative charge of £5.00 per person per night. Prices for accommodation only bookings can be quoted upon request.

Prices:
The prices we advertise are based on specially negotiated rates to be booked in specific hotels on certain dates. At the time of booking, if there is a lack of availability in the specified accommodation we will endeavour to secure alternative accommodation. If in the unlikely event that it becomes necessary to alter the dates of travel you will be informed prior to any booking. Before your booking comes into existence Habanaloko reserve the right to increase or decrease any advertised prices. Changes will be made known to you before you book.

Peak Season Supplements:
During peak periods such as Christmas and Easter when demand may outstrip the supply of accommodation, you may find that supplements are added to the cost of our holiday. The cost of these supplements will be quoted to you at the time of booking.

Payment & Cancellation: Your non-refundable deposit will be held towards the full cost of the holiday. The full cost must be paid to Habanaloko Holidays at least fourteen weeks, (98 days) before departure. Failure to pay the balance within this time period or cancellation by you will result in the loss of the deposit fee and we reserve the right to apply the cancellation charges shown below. In the case of holidays booked less than 98 days before departure the full cost of the holiday must be received by us at the time of sending your online booking form, or shorter time as we may specify. In the case of non-payment of balance by the due date we reserve the right to cancel your booking and retain your deposit. Please note that Habanaloko Limited do accept all major credit and debit card payments through the website and you may also make payment by transferring funds to our bank account. We strongly advise that any and all payments are made well in advance of deadlines to avoid disappointment.

In the case of holidays booked any cancellations made by you need to be received in writing. The charges below reflect our estimated loss as a result of dealing with your booking to the point of cancellation and any other losses we may have to pay. Cancellation will take effect from the date we are notified provided that written notification is received by us within 24 hours of the original notification.

If we cancel your holiday:
When we send written confirmation and invoice we try to avoid making changes to your holiday arrangements and endeavour to provide you with the holiday you booked, however we reserve the right in any circumstance to alter or cancel bookings. If we cancel due to lack of numbers or any other unforeseen circumstances we will refund all monies paid by you, but we shall be under no further obligation.

Change or Addition to your holiday:

If you do want to change any part of your holiday arrangements after the invoice has been issued, we will endeavour to make the change but this may not always be possible. Any request for changes must be made in writing by you or the person who made the booking. If it is possible to make the change, it will be subject to an administration charge of £35 per booking and payment of any further cost incurred as a result of the change. Airline carriers normally regard name changes as a cancellation and rebooking, and any alteration may incur a 100% cancellation charge in respect of the air fare. Please note that it will not be possible to make any change to your booking within 28 days of your departure date.

Transferring bookings:
If any person on a booking is prevented from travel as a result of illness, the death of a close relative, jury service or significant reason we will agree to the transfer of a booking to another person who satisfies all the conditions applicable to these terms and conditions, subject to both persons accepting liability for full payment of the holiday cost and any costs arising out of the transfer. The transfers will be subject to the airline and accommodation provider’s approval and an administration will be made of £50 per person for requests made more than 98 days before departure and £100 per person for requests made within 98 days of departure

Surcharges:
The price of your holiday is subject to surcharges on the following items: government action, currency, aircraft fuel, over flying charges, airport charges and increases in airfares. Habanaloko will absorb amounts equivalent to 2% of the holiday price excluding visa charges and amendment fees. Only amounts in excess of 2% will be surcharged. If this means that you will be paying more than 10% on the holiday price, you will be entitled to a full refund of all money paid except visa charges and amendment fees. Should you decide to cancel the holiday because of this we must receive written confirmation within 14 days from the issue date on your amended invoice.

The price of your holiday includes:
Transfers to and from the airport to your hotel when travelling in a group holiday. 7 to14 nights bed and breakfast accommodation depending upon package booked in four or five star hotel accommodation or Casa Particular in either a double, twin or triple room, From 1 to 21 hours of salsa classes depending on the package booked. Escort and guidance to recommended bars, clubs, venues and sights. Single rooms will incur a single supplement charge to be advised.

If you choose to leave the scheduled dance classes and planned activities you may not be able to re-join the group for other activities. This will be at the discretion of the host in consideration of all parties within the group.

Transport arrangements around the city of Havana during your stay will be your own responsibility but we will assist you where possible.

Flights:
You are responsible for arranging your own flights to and from Cuba.

Tickets:
Since our tickets are in the form of e-tickets and vouchers it is often not necessary to forward you any paper documentation prior to meeting up at the airport where we will check in together. When travelling independently we will insure you have all the documentation you require prior to departure.

The price of your holiday does not include:
Lunch, evening meals, drinks, club entrance, sightseeing and museum entrance, transport during your stay, optional excursions or activities booked during your holiday. Optional extras, sundry hotel expenses, (phone, email, laundry, room service etc., which must be settled by you before checking out), private salsa lessons or Cuban departure tax (25.00 convertible pesos )- This tax must be paid, in convertible pesos, direct to the Cuban authorities at the airport on your departure.

Meals:
The hotels we use supply either a set continental breakfast or buffet style breakfast. Lunch, dinner, drinks and snacks are your own responsibility and it is for you to ensure you buy sufficient water to drink during the classes and in general. Whilst the itinerary includes escort to certain restaurants at certain times other times you will be expected to make your own choice of restaurant. No refunds will be given to anyone choosing not to take breakfast. Special diets of any kind can seldom be catered for within the constraints of this kind of trip however guidance will be given on request. You are responsible for your meals on any excursions or day trips unless otherwise indicated.

Accommodation and Rooms:
Hotel grading may vary to your usual expectations in addition to variations between individual hotels and individual rooms.

Whilst we will pass on your request to the hotel for a twin or double bedded room or a particular facility or service we are unable to guarantee that it will be accommodated. All efforts will be made at the time of the stay to ensure your comfort and safety.
Supplements will apply for single rooms and prices will be confirmed at the time of booking. The standard of single rooms may vary to the standards of double/twin rooms and we cannot guarantee that there will be no such discrepancies.
Water and electricity services struggle to keep up with the increased demand from tourists and whilst hotels do everything possible to maintain full services occasional power cuts and/or water restrictions may be experienced.
In many hotels in the tropics insects in the room are almost inevitable and should not be taken as a sign of dirtiness however it may be advisable to take insect repellents for such occurrences.

If we change you holiday:
We plan arrangements a long time in advance of your holiday using independent suppliers such as airlines and hotels etc., over whom we have no direct control and are subject to their conditions. On occasions changes do have to be made and we reserve the right to make these. Most of these changes are minor however if we consider them a SIGNIFICANT CHANGE we will endeavour to advise you as soon as reasonably possible.

Habanaloko reserve the right at any time to make changes to your holiday arrangements, (including flights, accommodation, transport or services). Such changes will be kept to a minimum and every effort will be made to improve the quality of your holiday. If we make a significant change you may cancel your holiday and obtain a full refund of all monies paid by you to Habanaloko Limited. Insurance charges and visa costs cannot be refunded. No compensation will arise due to ‘force majuere’. Habanaloko are under no obligation to arrange a further trip for you if you choose not to accept the changes and cancel the trip booked.

Force Majuere:
We regret we cannot accept any liability or pay any compensation where performance of our obligations are prevented or affected by ‘force majuere’. In these booking conditions ‘force majuere’ means any event which we could not have foreseen or avoided, even with all due care. Such circumstances may include war, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, bad, unusual or adverse weather conditions, epidemic and all similar events outside our control.

Circumstances beyond our control:
Habanaloko will not be liable to pay any compensation if we are forced to cancel or in anyway change your holiday as a result of unusual or unforeseeable situations outside our control, the consequences of which could not have been avoided with all due care. These include unavoidable technical problems with transport, changes imposed by rescheduling or cancellation of flights by an airline, the alteration of the airline or aircraft type, the overbooking of accommodation by the supplier, the need to change accommodation.

Public Holidays:
Virtually all countries have public holidays, religious or otherwise. Festivities may temporarily disrupt your holiday and others may be fun to be a part of. Habanaloko will endeavour to work with such events but will not be held liable for any alteration to the planned itinerary due to such festivities.

Insurance:
Habanaloko Limited does not arrange your insurance and it is a condition of booking that you have your own adequate travel insurance arranged for travel and you provide us with the name and details of your insurance company. Habanaloko is not liable or responsible for the loss, damage or theft of any luggage, money, documents or any personal effects and any claim must be made through your own insurance company and it is your responsibility to report any such loss to the airline, hotel or Cuban authorities directly.

Habanaloko does not accept any liability or responsibility in the unfortunate event of death, personal injury or failure of your holiday arrangements and accept no liability for such either as a limited company or on behalf of its individuals. This disclaimer applies to any activity you take part in during your holiday whether organised by Habanaloko Limited or any activity organised and arranged independently of us. In joining the trip you understand that all activities are entered into at your own risk. You confirm that you have arranged your insurance for the period of travel, in order to provide you with adequate cover, particularly for cancellation, ill health, accidents and the loss, damage or theft of personal items. You understand that this is a condition of booking both by Habanaloko Limited and it is on this basis that Habanaloko have agreed to book your holiday. You confirm that if Habanaloko have to pay any costs for hospital cover, repatriation to the United Kingdom or any other costs as a result of your failure to arrange adequate insurance for your holiday/travel arrangements then you will reimburse Habanaloko and any of its representatives for all such costs.

We strongly recommend you have full insurance which, under certain circumstances, protect you from loss of deposit or cancellation fees.

Health:
Please consult you GP for vaccinations and health requirements prior to travel to Cuba. Whilst Habanaloko will be able to direct you to medical services your health is your own responsibility and Habanaloko accept no responsibility for any injury or accident incurred either during dance classes, at dance venues and as a result of other activities either whilst in the United Kingdom, Cuba or during travel. It is your responsibility to inform Habanaloko, in writing, of any medical condition you have at the time of booking. Habanaloko will advise you if any activity may be unsuitable however Habanaloko do not accept responsibility for any ill heath suffered by you during the trip or back in the United Kingdom as a consequence of any activity during the trip.

Escorted Tours General Health Requirements:
Most of our holidays are not suitable if you are confined to a wheelchair or have reduced mobility. Therefore, in the interests of safety and comfort for all groups as a whole you must be fit enough to participate or have an able bodied carer to assist you on the tour.

Behaviour:
We can end your holiday if your behaviour causes distress, damage, danger or annoyance to other members of the group and should this happen no refund or compensation would be paid. If your actions cause damage to any accommodation, transport or venue we visit or cause delay or diversion to any flight or other means of transport you undertake to fully indemnify Habanaloko for any claim including legal costs made against them by or on behalf of the owners of such accommodation or the operator of such flight or other means of transport.

You are responsible for your own actions in relation to the consumption of alcohol whilst on the trip and are fully aware that taking drugs to Cuba or during your stay in Cuba is illegal, unacceptable and will put you and all the other members of the group at risk. You agree not to take to Cuba any drugs for use other than prescription drugs prescribed solely for your own use and not to involve yourself with any persons taking drugs of any kind.
Habanaloko Limited accepts no liability for the actions of any member of the group involved in such or other criminal activity or activity which is likely to be viewed negatively by the Cuban authorities.

Similarly Habanaloko are unable to accept any responsibility for any inconvenience caused by other hotel guests, or any third party or those using the same clubs, and venues and transport as ourselves.

Cuban law differs dramatically from that of the United Kingdom and should you have any questions you should consult a member of the team. It is a condition of booking with Habanaloko that you respect the law and the Cuban authorities who are in the main there to protect tourists and eager to assist. You agree not to invite or allow a Cuban person into your room in the hotel at any time and respect the hotels right to refuse a Cuban person entrance.

Passports and Visas:

It is your responsibility to ensure you have a valid passport and, where applicable, all inoculations have been carried out prior to travel. All passports should be valid for at least six months after the date of your return.

We can arrange tourist visas and are able to offer assistance and advice in obtaining visas for British Passport holders, however we cannot be responsible if you are not granted a visa or are refused entry for any reason.

We will not accept any responsibility or refund any money in cases where you are unable to travel because of an invalid or mislaid visa or passport.

Tailor-made holidays:
Please note that all arrangements booked and confirmed by Habanaloko that vary with the group trips are subject to these same booking conditions.

Complaints:
If you have cause for complaint whilst on your holiday you must bring it to the attention of a member of the Habanaloko Team. They will do their best to rectify the situation. It is unreasonable to take no action whilst on your holiday and then write a letter of complaint upon return. If you do not raise concerns immediately this may affect our ability to investigate and take remedial action and it may impact the way the complaint is dealt with. Habanaloko also welcome any feedback you may have both during and following your trip.

Curtailment:
If you cut short your holiday and return home early in circumstances of your own choice we will not offer any refund for the remainder of the holiday or compensation or be liable for any charges incurred in your return. Depending on the circumstances, your travel insurance may offer cover for curtailment and any claim should be made directly to them.

Website accuracy:
We check the information on our website about Cuban internal flights, accommodation, itineraries etc., to ensure it is correct at the time of being added. However due to the nature of travel in Cuba and third party suppliers there may be changes to the information advertised on the website. When we are told of any significant or long term changes we will endeavour to advise you prior to departure.

Book your holiday:
To book your holiday Habanaloko will need to process and pass information about you and your holiday booking to tour operators, holiday providers and others (e.g. airlines, transport hire firms and accommodation providers) who may also need to process your details and your needs; such information may include, where relevant, dietary requirements (e.g. if you are a vegetarian), general health and religious and/or passport information, either within the United Kingdom or abroad.
To assist in obtaining the Tourist/ Visitor Visa necessary for travel to Cuba: To assist with travel arrangements and where necessary the information may be provided to security companies, public authorities such as customs/immigration if required by them, or as required by law. To prevent fraud and collect monies due. To contact you via email, letter or phone.
We will endeavour to ensure security measures are taken to protect your information and that such information is only used by third parties as necessary.

Habanaloko Commitment

Habanaloko Limited confirms accommodation and itineraries on your behalf in order for you to fully enjoy your holiday. The above booking conditions are comprehensive and aimed at protecting both you and other members of the dance groups and your travel party.

Please confirm you have fully understood and accept the booking conditions, including full acceptance that if you cancel the holiday cancellation charges may apply, that you understand the insurance disclaimer, and are over 18 years of age, by signing and returning both copies to the office address below. Please contact the office and notify us in writing if you have any member of your party under the age of 18. You will be required to sign a copy of these terms and conditions on their behalf.

We will sign and return a copy of these Terms and Conditions together with a copy of your Booking Form however if you have any questions or require further clarification please do not hesitate to contact Habanaloko.
